MEMORANDUM OPINION AND ORDER
LIMBAUGH, District Judge.
This case originated with the filing by petitioner, a state prisoner, of a 28 U.S.C. § 2254 petition for writ of habeas corpus. The matter was referred to a Magistrate for recommendation and this Court adopted the findings of the Magistrate and dismissed the claim.
