This action comes before the court on the defendants' motion to dismiss Counts I, II, III, IV and V of the complaint for lack of jurisdiction and Counts I, II, III, and IV for failure to state a claim upon which relief can be granted. The defendants have also moved to dismiss the plaintiff's request for punitive damages from Count II and to dismiss the individual defendants from Counts III, IV, and V. For the reasons stated...
