Defendant Local 1199, Drug, Hospital and Health Care Employees Union, RWDSU, AFL-CIO ("Local 1199"), has moved pursuant to Fed.R.Civ.P. 56 to dismiss plaintiff Russell Phillips' ("Phillips") complaint.
