MURRAY, Judge.

This is an appeal from the trial justice's order granting defendant Allen & Demurjian's (Allen) motion for summary judgment. We set forth the facts below in the light most favorable to the plaintiff, Forte Brothers, Inc. (Forte), as we must in reviewing the trial justice's granting of Allen's motion for summary judgment.
