MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Edward Gillespie ("Gillespie") moves to dismiss, on statute-of-limitations grounds, Counts Three and Four of the "superseding indictment" returned in this case on March 20, 1987 by the January 1987 Grand Jury. For the reasons stated in this memorandum opinion and order, Gillespie's motion is granted, though he has likely won only a Pyrrhic victory — for the United States is now free to reindict...
