AQUILINO, Judge:

This action has been brought pursuant to 19 U.S.C. § 1592 and 28 U.S.C. § 1582. Counts I, II and III of the complaint respectively allege fraud, gross negligence and negligence within the meaning of subsection (a) of section 1592 on the part of defendant Blum.
