Venezia to dismiss plaintiffs' complaint be and it is granted with respect to plaintiffs' claim arising under § 17(a) of the Securities Act of 1933, 15 U.S.C. § 77a, et seq., (1933 Act) and denied with respect to plaintiffs' remaining claims.
