On June 8, 1987, a portion of the abovecaptioned action was tried before the Court in admiralty. At issue in the proceedings held on that date were the respective rights of Maher Terminals, Inc. ("Maher") and Exchange Transport International ("Exchange") with respect to the fund (currently held in the registry of the Court) generated by the sale at auction of the M/V PORT OF SAVANNAH.
