The Court has before it the motion of the defendant, Western Geophysical Company of America, for partial summary judgment. The plaintiff was injured when a compressor, located aboard the defendant's seismic vessel the WESTERN PASSAGE, exploded. It is undisputed that the Oceanographic Research Vessels Act (ORVA), 46 U.S.C. § 441 et seq., applies to both the vessel and the plaintiff.1...
