Plaintiff, Polo Fashions, Inc. (Polo) has brought the present action for trademark infringement and unfair competition against defendant, Telesforo Fernández & Hno., Inc., d/b/a La Esquina Famosa (Telesforo).1 Jurisdiction is invoked pursuant to 15 U.S.C. § 1051 et seq. and 28 U.S.C. § 1338.
