The defendant, Edward Onesimo Romero, was charged with voting in the wrong precinct, a misdemeanor, section 1-13-709, 1B C.R.S. (1980), and four felony counts of providing false information regarding his residence, section 1-2-225, 1B C.R.S. (1980). The district court dismissed all charges, finding that the statute of limitations had run on the misdemeanor charge, and that the felony statute was unconstitutional as applied to the defendant because...
