This personal injury negligence action is presently before the Court on motion by defendant, Gateway Terminal Services Corporation ("Gateway"), to dismiss the complaint of plaintiffs, David and Christine Welch, and the cross-claim of co-defendant, Schneider National Bulk Carriers ("Schneider"), for failure to state claims upon which relief can be granted.
