This is an appeal from a judgment entered by the Clay Circuit Court after a jury returned a verdict finding appellant guilty of second-degree assault. Appellant contends that the trial court erred by failing to continue the trial of his case upon learning that a witness for the commonwealth was also a member of that month's circuit court jury panel, and by failing to instruct the jury on the offense of assault...
