The City of San Jose (City) appeals from a trial court grant of summary judgment, dismissal and award of attorney's fees entered in favor of respondent Great Oaks Water Company (Great Oaks). This action concerns the exercise of the right to provide water service within a portion of the San Jose water service area known as the "Expanded Edenvale Redevelopment Area, Phase I" (Edenvale Area).
