On October 8, 1975, the plaintiff, Maria F. Solimene, was injured while working with an industrial machine manufactured by the defendant, B. Grauel & Co., KG (Grauel). The plaintiff sought damages from Eastern Marking Machine Corporation (Eastern), which, she alleged, distributed the machine to her employer, and from the machine's manufacturer, Grauel, on the theories of negligent design and breach of warranty.
