Carey Michael Allen appeals a conviction for driving while intoxicated. Punishment was assessed at thirty days probated and a fine of $500.00.

No statement of facts or motion to extend the time for filing the statement of facts was filed within the time allowed. Consequently, we ordered the trial court to conduct a hearing to determine whether appellant had been deprived of a statement of facts because of ineffective counsel or for any other reason...
