ORDER

MOODY, District Judge.

This matter is before the court on a Motion for Partial Summary Judgment filed on March 3, 1987 by defendants Bishop Motor Express, Inc. and William A. Kitchen. Plaintiff Marie E. Heinhold filed in opposition on March 17, 1987 and defendants filed a reply on March 26, 1987. For the reasons discussed below, defendants' Motion for Partial Summary Judgment is hereby GRANTED.
