Presently pending before this Court are the plaintiff's Motion for a Preliminary Injunction pursuant to Fed.R.Civ.P. 65 and the defendant's Motion to Dismiss pursuant to Fed.R.Civ.P. 12(b)(6). On April 11, 1986, the Court heard oral arguments on the outstanding motions. For the reasons set forth below, the Court will grant the defendant's Motion to Dismiss.
