STEPHEN F. PRESLAR, Chief Justice.

This is an appeal from a declaratory judgment awarding the Appellee 37.45 percent of all future retirement benefits which a United States Army officer, grade 0-5 Lieutenant Colonel, is entitled to receive.

The parties were divorced in September, 1975. At the time of divorce, the trial court did not dispose of the Appellant's military retirement benefits. The court order provided that the retirement benefits...
