This case is now before the Court on various motions of the parties. As an initial matter, the Court will deny defendants' original motions to dismiss as moot. Plaintiff filed a first amended complaint on December 11, 1985, which resolves the issues raised in the motions to dismiss. In addition, the Court will deny defendants' motion for a more definite statement as to Count II. With respect to the summary judgment motions...
