MEMORANDUM ORDER
FISH, District Judge.
This case is before the court on the motion of defendant, the United States of America ("USA"), to dismiss the complaint filed by plaintiff Randy Earl Campbell ("Campbell") for failure to state a claim upon which relief can be granted.
