This is an action for pension benefits brought pursuant to the Employee Retirement Income Security Act ("ERISA"), 29 U.S.C. § 1001 et seq. On August 31, 1982, the plaintiff, John Serb, Jr., resigned or was forced to resign from his position as Secretary-Treasurer with Gagnier Products Company.
