MEMORANDUM OPINION AND ORDER

On the evening of May 22, 1980, between 11:30 p.m. and midnight, John Ryan, Jr. returned to his father's home in Pontiac, Michigan and found that his father, John Ryan, Sr. had been shot in the back of the head with his own .22 caliber rifle.
