Plaintiff American Original Corporation (the "plaintiff") filed this action initially in the Superior Court of the State of Delaware claiming that Legend, Inc. and Smooth Saturn, Inc. (collectively the "defendants"), breached a contract (the "Contract") with the plaintiff by selling their catch of surf clams to competitors of the plaintiff.
