Gary Wayne Karr was convicted of receiving stolen property in the first degree: a violation of § 13A-8-17, Code of Alabama 1975. He was sentenced as a habitual offender to ten years' imprisonment.

The evidence showed that on Wednesday, January 20, 1982, John Pate purchased at wholesale $3,360 worth of lumber from a lumberyard in Mississippi. The check given by Pate in payment of the lumber was worthless, and it was eventually returned marked...
