OPINION

FAY, Chief Justice.

The defendant appeals from a denial of a motion for new trial by a Supreme Court justice following a jury conviction of first-degree sexual assault. Although the defendant raises more than one ground for appeal, we find the issue of the state's discovery violation to be dispositive of the matter.
