MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Gregory Thompson ("Gregory") sues the United States1 under the Federal Tort Claims Act ("FTCA"), 28 U.S.C. §§ 1346(b) ("Section 1346(b)") and 2674 ("Section 2674"), claiming:

1. $2.5 million for Toni's wrongful death (Count I); 2. $5,000 for funeral bills and expenses on Toni's behalf (Count II);
