HOLDERMAN, District Judge:

Mr. Thomas J. Burns, Sr. died on December 5, 1985. His death set in motion this dispute pitting his children against his wife in an unsavory contest for his legacy. In particular, this cause of action relates to Mr. Burns' interest in the John Francis Roche, Jr. Savings and Profit Sharing Fund of Binks Manufacturing Company (hereinafter "Fund"). Mr. Burns was a long time employee of the Binks Manufacturing Company...
