This matter is before the Court for a decision on the merits after trial to the Court sitting in admiralty. The case was tried before the Court in two time periods, to accomodate scheduling, for a total of fifteen days. On the first day of trial, plaintiff orally moved to dismiss, with prejudice, a former defendant, McDonnell Douglas. The next day, the Court granted plaintiff's motion.
