We granted certiorari in this medical malpractice case to determine whether the trial court erred in finding the defendants negligent per se based on OCGA § 43-26-9 (b). The Court of Appeals affirmed. Central Anesthesia Assoc. v. Worthy, 173 Ga.App. 150 (325 S.E.2d 819) (1984).
