PARKS, Presiding Judge:

The appellant, Kenneth Ray Cook, was tried by jury for the crime of Murder in the First Degree in violation of 21 O.S. 1981, § 701.7 in the District Court of Woodward County, Case No. CRF-83-15. The jury returned a verdict of guilty on the lesser included offense of First Degree Manslaughter pursuant to 21 O.S. 1981, § 711, and set punishment at forty (40) years' imprisonment.
