MEMORANDUM

REGAN, District Judge.

This action is before the Court upon the motion of Jesse Brown, Jr., to vacate, set aside, or correct his sentence under 28 U.S.C. § 2255.

In Criminal Cause No. 82-170 CR (B), movant Brown on September 3, 1982 pled guilty to one count of violating 18 U.S.C. § 641. The range of penalties for that offense was a fine of up to $10,000, or imprisonment for up to ten years, or both said fine and imprisonment...
