Since July of 1976, defendant Dr. Hirsch had been treating Helen Horwath for hyperplasia. In the course of her treatment he performed a surgical procedure known as a D&C upon her. (This D&C procedure allows for the scraping of the uterine walls so that samples can be taken for diagnosis.) As a result of the D&C, she was diagnosed as having uterine cancer.
