BROWN, Justice.

Appellant was convicted by a jury of aggravated homicide by vehicle. In his appeal, he alleges error in the instructions given the jury.

According to appellant, the issue is:

"Whether the Appellant was denied a fair trial because the trial court refused to instruct the jury on the Appellant's theory of the case regarding the manner in which his vehicle was driven."
