Consolidated Freightways Corporation ("Consolidated") has charged Niedert Terminals, Inc. ("Niedert") with breach of warranty and fraudulent misrepresentation in connection with Niedert's sale of a trucking terminal to Consolidated. Each party has filed a Fed.R.Civ.P.
