This is a civil action brought by the administrator of the estate of Ernest J. Forand, Jr., pursuant to 42 U.S.C. § 1983. The defendants are William H. O'Brien ("O'Brien"), a Taunton Police Officer, Roger J. Renaud, Jr. ("Renaud"), Taunton Chief of Police, and the City of Taunton ("City"). The plaintiff alleges, inter alia, that Ernest J.
