Plaintiff Edward Boardman ("Boardman") brought this action alleging violations of Section 10(b) of the Securities Exchange Act of 1934, breach of fiduciary duty, breach of contract, and conversion. Defendants Simon Lipton ("Lipton"), Leung Wing Leung ("Leung") and Frank Masandrea ("Masandrea") now move for summary judgment pursuant to Fed.R. Civ.P. 56. For the following reasons, the motion is granted.
