This matter is presently before the Court on plaintiff's motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. This action is brought by plaintiff under the Labor-Management Reporting and Disclosure Act of 1959, 29 U.S.C. § 401 et seq.
