Currently before the court is petitioner Charlie Young's motion made pursuant to Rule 70 of the Federal Rules of Civil Procedure to enforce the judgment in this case entered by this court on December 5, 1980, in which this court ruled that petitioner was denied effective assistance of counsel at the sentencing phase of his trial. This court also noted that petitioner's death sentence was invalid because the evidence was not sufficient...
