Plaintiff, Mon-Rite Construction Company ("Mon-Rite"), appeals from the trial court's granting of defendant Northeast Ohio Regional Sewer District's ("Sewer District") motion for summary judgment. For the reasons adduced below, we hold that summary judgment was properly granted.
