This action has been brought under the provisions of the Federal Tort Claims Act, 28 U.S.C. §§ 1346 and 2671, et seq., (FTCA). Plaintiff Marie Sheppard (Mrs. Sheppard) seeks to establish that her daughter Laura Sheppard (Laura) is dead, and that claimed negligent actions of Bureau of Indian Affairs personnel proximately caused the death.
