MEMORANDUM OPINION

Plaintiff Ellen G. McCloud filed this action on July 2, 1981 alleging that the defendant Fairchild Industries, Inc., in failing to promote her, discriminated against her because of her race and sex in violation of Title VII of the Civil Rights Act of 19641 and the Civil Rights Act of 1866.2
