Plaintiff Arnold Pross ("Pross") originally commenced this action against his broker, Baird, Patrick & Co., Inc. ("Baird"), alleging violations of Securities and Exchange Commission ("SEC") Rule 10b-5, 17 C.F.R. § 240.10b-5, and state law claims for breach of contract and breach of fiduciary duty.
