OPINION
WARRINER, District Judge.
On 21 September 1984 petitioner, by counsel, submitted his motion for a stay of execution and a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. It was filed on 24 September in forma pauperis. In view of the impending execution date the Court entered an order establishing an expedited briefing schedule on the date of submission.
