This matter is before the Court upon defendants' motion to dismiss plaintiffs' complaint for failure to state a claim and for lack of subject matter jurisdiction. Upon its initial consideration of defendants' motion, the Court determined that relevant issues regarding abstention from federal jurisdiction had not been addressed by the parties, and ordered further briefs to be filed.
