FACTS

This case arises out of an action brought by plaintiff for declaratory relief from the court that it had cured an alleged violation of § 1 of the Sherman Act, 15 U.S.C. § 1. Plaintiff, a newspaper publisher, had a resale price maintenance provision in its contract with defendants, who were independent newspaper distributors.
