NEWMAN, Chief Judge:

Gregory Lucas was convicted in a bench trial on April 27, 1978, of sodomy, enticing a minor, and taking indecent liberties with a minor. In this consolidated appeal, which includes Mr. Lucas' direct appeal as well as appeals from denial of two habeas corpus petitions, Lucas contends: (1) that his conviction should be reversed because the loss by the court reporter of portions of the trial transcript prejudiced his ability to appeal his conviction...
