The defendants, Philip Ingeneri and Gardner Foss, appeal from a declaratory judgment entered in the Superior Court (Penobscot County) determining that plaintiff has no duty to defend or to indemnify its insured, defendant Ingeneri, in the legal malpractice action brought against Ingeneri by his former client, defendant Foss. On appeal defendants contend that the plaintiff malpractice insurance carrier is not relieved of its obligations under the policy...
