MEMORANDUM OPINION AND ORDER

JOINER, District Judge.

This is an action for a refund of a penalty imposed under 26 U.S.C. § 67021 for filing what amounts to a "frivolous" tax return. The case is before the court on defendant's motion to dismiss, which, for the reasons stated herein, is granted.
