This appeal is from a Jefferson Circuit Court order overruling appellants' motion for attorney's fees pursuant to KRS 304.39.070(5).

On February 29, 1980, Daniel Drake was a passenger in an automobile driven by Michael Gutman which was involved in a collision with an automobile being driven by Scott Tabor and owned by Linda Summers.
